Welcome to the website of Oak Outreach WI! These Terms and Conditions ("Terms") govern your access to and use of our website and the free gardening services we provide. By accessing or using our Site and services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Site or services.

These Terms constitute a legally binding agreement between you and Oak Outreach WI. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site and services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.
2. Eligibility for Services
Our free gardening services are specifically designed for and offered to:

Seniors (typically individuals aged 65 or older, or as otherwise defined by our internal policies).

Individuals with mobility disabilities who are unable to perform gardening tasks themselves.

Veterans (retired or currently in service).
By requesting our services, you confirm that you meet these eligibility criteria. We reserve the right to verify eligibility through a follow-up call or other reasonable means as outlined in our Privacy Policy. Providing false information regarding your eligibility may result in the refusal or cancellation of services.
3. Our Services
Oak Outreach WI provides free, volunteer-based gardening assistance. Our services typically include, but are not limited to, weeding, planting, light pruning, and general garden tidying. We aim to assist with tasks that are challenging for our eligible clients due to age or mobility limitations.

No Charge: All gardening services provided by Oak Outreach WI are completely free of charge. We do not accept payment for our services.

Volunteer Basis: Our services are performed by dedicated volunteers. While we strive for professionalism and quality, the scope and availability of services may vary based on volunteer availability and capacity.

Right to Refuse/Limit Service: We reserve the right to refuse or limit service to any individual.
4. Booking Appointments

Request Basis: All service requests are made through our website's booking system.

Confirmation: Submitting a booking request does not guarantee service. All requests are subject to review, eligibility verification, and volunteer availability. You will receive a confirmation once your appointment is scheduled.

Accuracy of Information: You are responsible for providing accurate and complete information when booking an appointment, including your contact details, address, and details about your gardening needs.
5. Client Responsibilities
As a client receiving services from Oak Outreach WI, you agree to:

Provide a safe and accessible environment for our volunteers to work.

Communicate clearly about the specific gardening tasks you need assistance with.

Ensure any pets are secured during the volunteers' visit.

Notify us promptly if you need to cancel or reschedule an appointment.

Treat our volunteers with respect and courtesy.
6. Disclaimer of Warranties
Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Oak Outreach WI does not warrant that:

The services will be uninterrupted, timely, secure, or error-free.

The results that may be obtained from the use of the services will be accurate or reliable.

The quality of any products, services, information, or other material obtained by you through the services will meet your expectations.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Oak Outreach WI, its directors, officers, employees, volunteers, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

Any conduct or content of any third party on the services.

Any content obtained from the services.

Unauthorized access, use, or alteration of your transmissions or content.
8. Intellectual Property
The content, features, and functionality of the Site (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Oak Outreach WI its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as generally permitted for your personal, non-commercial use.
9. Termination of Services
We may suspend or terminate your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the services will immediately cease.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions.
11. Entire Agreement
These Terms constitute the entire agreement between you and Oak Outreach WI regarding our services and supersede and replace any prior agreements, understandings, or representations, whether written or oral, regarding such services.
12. Property Access and Consent
By requesting and accepting services from Oak Outreach Wisconsin, the client (property owner or authorized resident) hereby grants express permission to Oak Outreach Wisconsin and its authorized volunteers, employees, or contractors to enter and access the designated property for the sole purpose of performing the requested landscaping and yard work services.
This permission extends to all necessary areas of the property required for the safe and effective execution of the agreed-upon services, including but not limited to, the yard, garden areas, and pathways directly associated with the service request. Access will be limited to the times and dates mutually agreed upon for service delivery.
The client acknowledges that by submitting a service request and agreeing to receive services, they are providing consent for such access. It is the client's responsibility to ensure the property is accessible and safe for service personnel during the scheduled service times.

Volunteer Terms and Conditions Agreement
This Volunteer Terms and Conditions Agreement ("Agreement") is entered into by and between Oak Outreach Wisconsin, a non-profit organization ("the Organization"), and the undersigned volunteer ("the Volunteer"). This Agreement outlines the terms of the voluntary relationship and serves as a formal acknowledgment of the responsibilities and expectations of both parties. By using the signupgenius sent through email after applying, the volunteer automatically agrees to all of these terms and conditions.
1. Voluntary Relationship
The Volunteer acknowledges that their relationship with the Organization is a voluntary one. The Volunteer is not an employee, independent contractor, or agent of the Organization. This Agreement is not a contract for employment, and no compensation, benefits, or privileges of employment are implied or provided. The Volunteer's services are provided freely and without expectation of wages, salary, or other forms of compensation.
2. Volunteer Responsibilities
The Volunteer agrees to:
Perform all volunteer duties to the best of their ability and with a positive attitude.
Adhere to all rules, policies, and procedures of the Organization, including those related to safety, conduct, and confidentiality.
Comply with all reasonable instructions and directions from the Organization's staff and supervisors.
Maintain the confidentiality of any private or sensitive information they may encounter during their volunteer work.
Notify the Organization immediately of any accidents, incidents, or safety concerns.
3. Code of Conduct
The Volunteer will act with integrity, respect, and professionalism at all times. The Volunteer agrees to:
Treat all individuals, including other volunteers, staff, and community members, with dignity and respect.
Refrain from any form of harassment, discrimination, or abusive behavior.
Not be under the influence of alcohol or illegal drugs while performing volunteer duties.
Use any tools, equipment, or property of the Organization responsibly and only for the purposes for which they were intended.
4. Release and Waiver of Liability
The Volunteer acknowledges that participation in volunteer activities for Oak Outreach Wisconsin may involve risks of personal injury, illness, property damage, or death. The Volunteer, on behalf of themselves, their heirs, and personal representatives, hereby releases, waives, and forever discharges the Organization, its officers, directors, employees, and agents from any and all claims, demands, liabilities, actions, or causes of action of any kind, whether in law or equity, arising from or in any way related to the Volunteer's participation in the activities of the Organization.
This release and waiver includes any claims for negligence, whether ordinary or gross, on the part of the Organization, its officers, directors, employees, or agents. It does not apply to claims resulting from intentional or willful misconduct.
The Volunteer understands that the Organization does not provide insurance coverage for injuries, property damage, or other losses incurred by the Volunteer while participating in volunteer activities. The Volunteer is responsible for their own health, medical, and personal property insurance.
5. Media Release
The Volunteer grants the Organization the irrevocable right and permission to use, publish, and license their name, likeness, image, voice, and/or appearance as recorded on film, video, photograph, audio recording, or any other media for educational, promotional, or archival purposes, without compensation.
6. Termination
This Agreement may be terminated by either the Volunteer or the Organization at any time, for any reason, without prior notice.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin.
